    Terms & Conditions

    General

    These general terms and conditions (the “Terms”) apply when You as a consumer (the ”Customer” or “You ") place an order via www.vagabond.com and thereto related pages (the ”Website”). An agreement is concluded between You and Vagabond R1 AB, company registration number 556634-4890 and VAT registration no. SE 55663448901 (“Vagabond”, “us” or “we”). Detailed contact information and other information about Vagabond is provided on the Website. These Terms only apply for Customers who are consumers when they order online on the Website.

    Vagabond is a Swedish company that complies with Swedish law including EU regulations and directives. Furthermore, Vagabond strives to always comply with mandatory consumer protection laws and regulations where the customer has its country of residence. Vagabond cannot guarantee that these Terms comply with all applicable mandatory consumer protection laws. Nothing in these Terms shall exclude or limit Vagabond’s liability with regard to any matter for which it would be unlawful for Vagabond to limit or exclude its liability according to applicable mandatory law.

    Vagabond has the right to deny purchases by a customer that does not, according to applicable mandatory law in the customer’s country of residence, have the right to enter into agreements regarding purchase of the products sold by Vagabond, e.g. normally under 18 years old. By purchasing a product at the Website You confirm that You possess the legal right and ability to enter into a binding agreement with Vagabond.

    Orders

    In the event of orders that appear to be incorrect or significantly deviate from typical orders, you accept that vagabond may contact you to ensure that your order is correct. You will enter into an agreement with Vagabond in English and, in order to make a purchase, You must accept the Terms. By ticking the box of Terms and Conditions in the checkout on our web-site You accept the Terms and You undertake to comply with them.
    Vagabond will process Your order immediately after You have placed an order on the Website. The agreement between You and Vagabond is concluded when You receive an order confirmation from Vagabond by e-mail. This means that a purchase contract for which these Terms apply is not entered into until You have received an order confirmation from Vagabond. Vagabond strives to send the order confirmation to You as soon as possible after receiving an order. We recommend You to save the order confirmation to facilitate any contact with our customer care in case such contact is needed.

    Prices and fees

    All prices are presented in local currency and include VAT. The prices do not include any payment fees, shipping fees or customs duty, which are presented separately.
    The price of the product that was indicated on the Website when You placed Your order is the price that shall apply, unless otherwise is expressly agreed or if the circumstances clearly dictate otherwise. Vagabond is however not bound by a price for a product which was presented incorrectly on the Website if You realized or should have realized that the product was mispriced.

    Payment

    Vagabond offers various payment methods for Your purchase, but they vary depending on your residence. View our Help & Contacts-page to see which payment methods that are available in your country. The different payment methods may vary from time to time therefore Vagabond reserves the right to not always offer all payment methods. Please note that any restrictions on the payment options are set forth on the Website.

    You can choose to pay via debit and credit card in all countries. The applicable amount will immediately be reserved on Your credit card but will not be debited until the goods are sent out. The payment transaction is carried out in cooperation with our payment service provider Adyen.

    For certain countries, You can also choose to pay by invoice, if it is possible it is indicated during the check-out session. If You choose to pay by any of Klarnas payment methods, Vagabond’s right to receive payment and all other rights associated thereby are assigned to Klarna. Payment by using invoice may therefore only be done to Klarna and Klarna’s terms and conditions will apply in addition to these Terms. Click Here to view Klarna's terms.

    Campaigns and special offers

    Vagabond may from time to time offer campaigns and special offers to its customers on more favorable terms and conditions than what is stated in these Terms. These more favorable terms and conditions will apply only for the duration of the special offer and for those specific products set forth by Vagabond in connection therewith and will not imply that such offer shall be valid for any order entered into prior to such campaigns or special offer. Vagabond reserves the right to withdraw such campaigns and special offers at any time. Upon termination or withdrawal of a campaign or special offer, these Terms shall apply without modification. Offers regarding specific products are valid for a limited period of time and while in stock.

    Delivery

    Unless otherwise is explicitly stated, prices do not include shipping and delivery costs. The shipping and delivery cost is always stated on the Website and in the order confirmation.

    Vagabond always aims to deliver Your order within the estimated number of working days for delivery set forth on the Website and in Your order confirmation. Your order will be processed and shipped during normal working days i.e. between Mondays and Fridays, so if You place an order during a weekend or on a Swedish public holiday, it will be processed on the following working day. The expected delivery time is always stated on the Website and in the order confirmation. The time of delivery may vary depending on to which location the product shall be delivered and due to seasonal peaks.

    If You have not received Your order within the expected delivery date, You can always contact us at customer care for further information.

    Vagabond offers delivery to the countries listed on the Website. Please note that, from time to time, restrictions in the delivery may occur.

    Vagabond does not deliver products to an address in a country or region that is illegal for Vagabond to deliver to (for example when there is a trade embargo), where there is a war, conflict or instability of any kind.

    Non-collected package

    You shall retrieve, collect or receive the package within 14 days from the announced delivery date and in accordance with the instructions from time to time provided by Vagabond or the freight company. You will receive a notice indicating where and when the package may be retrieved or received. Unclaimed or non-received packages will be returned to Vagabond. For unclaimed or non-received packages, You will be charged a fee of 30 Euro.

    Please note that a non-collected package is not considered as a withdrawal from the contract. For more information on how to withdraw from the contract, see the section below.

    Retours

    Lorsque Vous achetez des produits sur le site Web, Vous avez le droit de Vous retirer du contrat pendant une période de rétractation de 14 jours, conformément à la législation européenne applicable en matière de protection des consommateurs. Si Vous deviez manipuler le produit au-delà de cela, Vagabond a le droit de procéder à une déduction pour toute valeur diminuée du produit en raison de cette manipulation, voir la section ci-dessous.

    Le droit de rétractation ne s’applique pas à un produit dont le sceau est rompu, à condition que le produit ne puisse pas être retourné pour des raisons de protection de la santé ou d’hygiène. Lorsque Vous commandez un produit pour lequel le droit de rétractation ne s’applique pas, Vous recevrez des informations claires à ce sujet.

    Si Vous souhaitez exercer votre droit de rétractation à temps, veuillez envoyer une notification à Vagabond indiquant que Vous souhaitez exercer votre droit de rétractation ou visiter l’un de nos magasins Vagabond avant l’expiration du délai de rétractation. Si Vous souhaitez exercer votre droit de rétractation en retournant le produit dans l’un de nos magasins Vagabond, Vous pouvez trouver le magasin Vagabond le plus proche iciPour faciliter le retrait sans Vous rendre dans l’un de nos magasins Vagabond, Vous devez prendre l’une des mesures suivantes :

    • Pour les produits livrés et retournés par Postnord, Vous pouvez utiliser l’étiquette de retour préimprimée fournie avec Votre colis.
    • Pour les produits livrés et retournés par DHL, Vous pouvez utiliser le portail Vagabond pour les retours situés ici.
    • Vous pouvez également contacter notre service client pour de plus amples informations.

    Lorsque Vous exercez votre droit de rétractation dans toutes les communications, Vous devez indiquer le nom, l’adresse et, de préférence, d’autres informations pertinentes, comme le numéro de commande et la date de commande, et si Vous avez acheté plusieurs produits , quels produits Vous souhaitez retirer .

    Veuillez noter que pour les produits que Vous avez achetés sur notre boutique en ligne, il n’est pas possible de retourner ces produits dans nos magasins Vagabond. Ce produit doit nous être retourné en nous le renvoyant en utilisant l’une des méthodes décrites ci-dessus.

    Si Vous souhaitez exercer votre droit de rétractation sur une commande complète, en utilisant notre étiquette de retour prépayée et préimprimée, nous déduirons les frais d’expédition du remboursement. Si Vous nous envoyez le produit sans utiliser nos étiquettes prépayées et préimprimées, Vous devez payer les frais de retour. Vous êtes également responsable de l’état du produit dès sa réception et pendant le retour. Par conséquent, Vagabond Vous recommande d’envoyer le produit bien emballé et dans sa boîte et/ou son emballage d’origine. Le produit sera retourné dans un délai de 14 jours à compter de la date de réception par Vagabond de votre notification indiquant que Vous souhaitez exercer votre droit de rétractation.

    Lorsque Vous exercerez votre droit de rétractation, Vagabond Vous remboursera le produit retourné. Vagabond a le droit de déduire une somme correspondant à la valeur diminuée du produit par rapport à la valeur initiale. Ceci s’applique uniquement si et dans la mesure où Vous êtes responsable de toute dépréciation du produit résultant de sa manipulation autre que ce qui est nécessaire pour établir la nature, les caractéristiques et le fonctionnement du produit.

    Remboursement

    En règle générale, Vagabond remboursera les paiements au plus tard 14 jours après la date de réception par Vagabond de votre notification indiquant que Vous souhaitez exercer votre droit de rétractation. Toutefois, aucun remboursement ne sera effectué tant que Vagabond n’aura pas reçu le produit ou que Vous n’aurez pas démontré que le produit a été retourné. Le remboursement Vous sera effectué par le même moyen de paiement et sur le même compte que celui choisi pour le paiement du produit, sauf accord contraire ou si un obstacle à ce mode de remboursement survient, Vous devez nous contacter au service client afin de prendre les dispositions appropriées pour le remboursement.

    Si Vous nous envoyez le produit sans utiliser nos étiquettes prépayées et préimprimées, Vous devez payer les frais de retour.

    Complaints

    A customer is entitled to lodge a complaint for a defect in the product according to mandatory consumer protection laws and regulations where the customer has its country of residence. If You wish to lodge a complaint regarding a delivered product You shall contact Vagabond as soon as possible after discovering the defect. To be valid, the complaint must be made within a reasonable time after You have discovered or should have discovered the defect.

    To facilitate a complaint You can contact our customer care using our contact form, located Here. State Your name, e-mail, address and preferably other relevant information, e.g. order number, date of order and why You lodge a complaint. Our customer care will then help You with Your claim. You can also lodge a complaint by visit any of our Vagabond stores. If You want to lodge a complaint by returning the product in any of our Vagabond stores, You can find Your nearest Vagabond store Here.

    Returns shall be made to Vagabond according to the methods and procedures specified in these Terms, under ”Returns”. Vagabond will carry the cost for the return freight for any approved complaints.

    When Vagabond has received a complaint of a product and has established that the complaint is valid and acceptable in accordance with applicable legislation, Vagabond will replace the product, rectify the defect, make a deduction on the price the customer has paid for the product or reimburse the payment including shipping fees If Vagabond decides to rectify or send a new product, Vagabond will strive to rectify or send a new product as soon as possible.

    Within two years, you have the right to make a complaint regarding production defects.

    Vagabond reserves the right to deny a complaint if it turns out that the product is not defect according to current legislation.

    Data protection

    Intellectual property rights

    The information on the Website is protected by, among others, intellectual property and marketing legislation. The Vagabond trademarks, trade names, product names, images and graphics, design, layout and information on products, services and other content may not be copied or used without the prior written consent of Vagabond.

    Personal data

    When You place an order at the Website You will be asked to provide certain personal data. You confirm that the information You provide is correct and complete, and You are responsible for incorrectly completed tasks. Information regarding Vagabond’s processing of personal data can be found in Vagabond’s Privacy Policy.

    Miscellaneous

    Any waiver of Vagabond of any of its rights or remedies under these Terms must be in writing and duly executed. No single or partial waiver of any such right or remedy shall preclude any other or further exercise of that or any other such right or remedy.

    Vagabond has the right to assign any part of its rights and obligations under the agreement between the parties without prior consent from the Customer. Furthermore, Vagabond has the right to assign or pledge receivables without prior consent from the Customer. The Customer may not however assign or transfer any part of its rights or obligations under the agreement between the parties without the prior written consent of Vagabond.

    Vagabond reserves the right to make amendments to these Terms from time to time. Any amendments to these Terms will be posted on the Website. Changes will become valid once You has accepted the Terms (in connection with a new purchase), or 30 days after Vagabond has informed You of the changes.

    Vagabond reserves the right to immediately suspend or restrict your use of the Website if it is used in an unintended manner. This may, for example, apply to uses that cause an unusual number of returns or any kind of security issues.

    Governing law and disputes

    In cases of any dispute with a customer, Vagabond will follow the submitted recommendations from the Swedish National Board for Consumer Disputes or any corresponding alternative dispute resolutions where the customer has its country of residence. The Swedish National Board for Consumer Disputes may be accessed either via the website www.arn.se or address Box 174, 101 23 Stockholm. A customer may also lodge a complaint at the European Commission’s platform for online dispute resolution (the “ODR platform”) which You may access here: http://ec.europa.eu/consumers/odr/.

    Any dispute regarding the interpretation or application of these Terms shall be governed by and construed in accordance with Swedish law and, except as provided in section above, settled by public court. Swedish law shall not however apply in a situation where a customer has better rights according to mandatory applicable consumer protection law in the country where the customer resides.

    If any provision of these Terms is to be held invalid or unenforceable by any competent court, authority, arbitral tribunal or alternative dispute resolution board, the remainder of that provision and all other provisions will remain valid and enforceable to the fullest extent permitted by applicable law.

    Notwithstanding the foregoing, Vagabond may take any legal action necessary at any competent court in the Customer’s country of residence for collection of delayed payments. The parties do hereby accept that the jurisdiction of such court shall apply for such purpose.

    Limitation of liability

    Vagabond is only liable for damages according to applicable mandatory consumer protection law and to the extent the customer has made reasonable measures to limit the loss. Vagabond shall not be held liable for damages regarding delays in the performance of the agreement or defect products caused by unforeseen circumstances beyond its control or for any loss in trade or business operations.
